2020 Resolutions
RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA ACKNOWLEDGING THE APPOINTMENT OF VACANCIES IN THE OFFICE OF BOROUGH COUNCILPERSONS.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania from time to time has vacancies in the office of Councilperson and it is the duty of Borough Council to fill such vacancies, the following appointments to fill vacancies is hereby recognized and resolved; and
WHEREAS, a vacancy occurred at the time of the January 6, 2020 public meeting and the vacancy was subsequently filled by a vote of Council on January 6, 2020; and
WHEREAS, it is resolved that Brian Snyder was appointed by a majority vote of Council to fill two years of the unexpired term as Councilperson for the Third Ward, said term to expire on the first Monday in January after the next municipal election.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Tarentum that Brian Snyder, Third Ward is hereby appointed as Councilperson by and for the Borough of Tarentum until the first Monday in January after the next municipal election.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA AUTHORIZING THE EXECUTION OF AN AUTOMATED RED LIGHT ENFORCEMENT FUNDING PROGRAM GRANT AGREEMENT WITH THE PENNSYLVANIA DEPARTMENT OF TRANSPORTATION.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, previously submitted a 2019 Automated Red Light Enforcement (ARLE) Funding Program Application in the amount of $226,000 to be used for traffic signal replacement and public improvements of the intersection located at East 10th Avenue and Corbet Street; and
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, has been awarded funding in the amount of $226,000 and desires to execute the project funding agreement with the Pennsylvania Department of Transportation; and
NOW, THEREFORE, BE IT RESOLVED, that the Borough of Tarentum does hereby designate the Borough Manager (the “Authorized Official”) as the official to execute the Grant Agreement, all future grant-related documents and forms between the Borough of Tarentum and the Pennsylvania Department of Transportation.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA TO VOLUNTARILY COMPLY WITH THE EMERGENCY ORDER ISSUED BY THE PENNSYLVANIA PUBLIC UTILITY COMMISSION ON MARCH 13, 2020 AT DOCKET NO: M-2020-3019244 PROHIBITING PUBLIC UTILITIES FROM TERMINATING UTILITY SERVICE DURING THE PENDENCY OF THE PROCLAMATION OF DISASTER EMERGENCY PROCLAIMED BY PENNSYLVANIA GOVERNOR TOM WOLF IN RESPONSE TO THE CORONAVIRUS (COVID-19) OUTBREAK.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, is authorized under the Borough Code Section 3301.1 to adopt ordinances and resolutions for any purpose and as deemed beneficial to the borough, 8 Pa C.S. § 3301.1, and to make regulations as may be necessary for the health, safety, and general welfare of the borough, 8 Pa. C.S. § 1202(5); and
WHEREAS, on March 6, 2020, pursuant to Section 7301(c) of the Emergency Management Services Code, 35 Pa. C.S. § 7101, et seq., Governor Tom Wolf issued a Proclamation of Disaster Emergency, proclaiming the existence of a disaster emergency across the Commonwealth of Pennsylvania as a result of the spread of coronavirus (COVID-19); and
WHEREAS, on March 13, 2020, United States President Donald J. Trump proclaimed that the COVID-19 outbreak in the United States constituted a national emergency, beginning March 1, 2020; and
WHEREAS, on March 13, 2020, Chairperson of the Pennsylvania Public Utility Commission (“PUC”) Gladys Brown Dutrieuille issued an Emergency Order pursuant to 52 Pa. Code §§ 3.1 and 3.2 prohibiting all electric, natural gas, water, wastewater, telecommunications, and steam utilities subject to the Pennsylvania Public Utility Commission’s jurisdiction from terminating service during the pendency of the Proclamation of Disaster Emergency issued by Governor Tom Wolf, unless to ameliorate a safety emergency; and
WHEREAS, the Borough of Tarentum is not a utility subject to the jurisdiction of the Pennsylvania Public Utility Commission, but desires to voluntarily comply with the PUC Emergency Order and adopt a resolution modifying our policy on utility terminations by declining to terminate utility services during the pendency of the Proclamation of Disaster Emergency issued by Governor Tom Wolf; and
WHEREAS, the Borough of Tarentum offers electric and water service within the Borough of Tarentum; and
WHEREAS, the Borough of Tarentum recognizes the uncertainty caused by the COVID-19 outbreak and that suspension of its utility termination policy during the pendency of the Proclamation of Disaster Emergency is in the best interests of the health, safety, and general welfare of citizens and residents of the Borough of Tarentum; and
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, as follows:
SECTION 1: The recitals set forth above are incorporated herein by reference.
SECTION 2: The Borough of Tarentum shall voluntarily comply with the March 13, 2020 PUC Emergency Order prohibiting utility termination during the pendency of the Proclamation of Disaster Emergency proclaimed by Governor Tom Wolf on March 6, 2020.
SECTION 3: The Borough of Tarentum shall not terminate electric and water utility services during the pendency of the Proclamation of Disaster Emergency, subject to the reservation of authority set forth in Section 4.
SECTION 4: The Borough Council of the Borough of Tarentum shall retain the authority to amend or repeal this Resolution for any reason and at any time prior to the termination of the March 6, 2020 Proclamation of Disaster Emergency.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA TO OPT OUT OF THE WATER SUPPLY CONTRACT AGREEMENT BETWEEN THE TOWNSHIP OF EAST DEER AND BOROUGH OF TARENTUM.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, is authorized under the Borough Code Section 3301.1 to adopt ordinances and resolutions for any purpose and as deemed beneficial to the borough, 8 Pa C.S. § 3301.1; and
WHEREAS, the Borough of Tarentum and the Township of East Deer executed a contract agreement on the 21st day of February, 1972, providing for the Township of East Deer to purchase water supply and the Borough of Tarentum to furnish and sell water supply to the Township of East Deer; and
WHEREAS, the Borough of Tarentum formally adopted the terms and conditions of this agreement by the adoption of Ordinance #2014 at a public meeting held on or about February 1972; and
WHEREAS, the Borough of Tarentum desires to opt out of the existing water supply contract agreement and provide notice thereof to the Township of East Deer; and
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, as follows:
SECTION 1: The recitals set forth above are incorporated herein by reference.
SECTION 2: Pursuant to paragraph 11 of the agreement, the initial term of the contract was set for a fifteen (15) year period, said term to expire on March 31, 1987. The agreement also provides for the term of the contract to automatically extend for additional periods of fifteen (15) years unless one of the parties notifies the other, in writing, of its intention to not be bound for the next fifteen (15) year period. Said notice shall occur at least one year prior to the expiration of the contract or any fifteen (15) year extension thereof.
SECTION 3: It appearing to the Borough of Tarentum that the terms and conditions of the contract are no longer in the best interests of the Borough of Tarentum, and said agreement is unilaterally beneficial to the Township of East Deer.
SECTION 4: It further appearing that the term of the contract has automatically extended for three (3) consecutive terms of fifteen (15) years, most recently on or about March 31, 2017, the Borough of Tarentum does wish to opt out of the existing agreement set to expire on or about March 31, 2032.
SECTION 5: The Manager of the Borough of Tarentum shall provide written notice to the Township of East Deer of its intention to not be bound by the agreement set to expire on or about March 31, 2032.
SECTION 6: The Borough Council of the Borough of Tarentum hereby adopts this Resolution to formally recite its intention to not be bound by any future automatic contract extensions.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA TO REPEAL RESOLUTION #20-03 AND REINSTATING THE TERMINATION PROCEDURE FOR UTILITY SERVICE IN TARENTUM BOROUGH.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, is authorized under the Borough Code Section 3301.1 to adopt ordinances and resolutions for any purpose and as deemed beneficial to the borough, 8 Pa C.S. § 3301.1, and to make regulations as may be necessary for the health, safety, and general welfare of the borough, 8 Pa. C.S. § 1202(5); and

WHEREAS, the Borough of Tarentum is not administratively and financially able to maintain voluntary conformity with the Pennsylvania Public Utility Commission’s termination procedure and desires to reinstate the Tarentum Borough utility termination procedure effective August 1, 2020; and
WHEREAS, pursuant to Tarentum Borough Resolution #20-03, the Borough Council of the Borough of Tarentum retained the authority to amend or repeal said Resolution for any reason and at any time during the Pennsylvania Proclamation of Disaster Emergency.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, as follows:
SECTION 1: The recitals set forth above are incorporated herein by reference.
SECTION 2: The Borough of Tarentum shall no longer voluntarily comply with the March 13, 2020 PUC Emergency Order prohibiting utility termination during the pendency of the Proclamation of Disaster Emergency extended by Governor Tom Wolf on June 3, 2020.
SECTION 3: The Borough of Tarentum shall resume termination of electric and water utility services beginning on August 1, 2020.
SECTION 4: The Borough Council of the Borough of Tarentum shall retain the authority to amend or repeal this Resolution for any reason and at any time during the pendency of the Pennsylvania Proclamation of Disaster Emergency.
RESOLVED and ENACTED this 7th day of July, 2020.
RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA AUTHORIZING THE FILING OF AN APPLICATION FOR FUNDS WITH THE REDEVELOPMENT AUTHORITY OF ALLEGHENY COUNTY (“RAAC”).
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, authorizes the filing of an application for $500,000 in funds with the RAAC;
NOW, THEREFORE, BE IT RESOLVED, that the Borough of Tarentum of Allegheny County hereby formally requests a grant from the RAAC for the Borough of Tarentum 7th Avenue and Ormond Street Spring Removal project.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough of Tarentum does hereby designate Thomas J. Benecki (the “Authorized Official”) as the official to file all applications, documents and forms between the Borough of Tarentum and the RAAC.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Applicant is hereby authorized to enter into the Grant Contract between the applicant and RAAC (the “Grant Contract”) and any and all documents relating to the Grant Contract as may be required or necessary (said Grant Contract and other documents are collectively referred to as the “Grant Documents”).
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the execution and delivery of the Grant Documents as well as all other agreements, writings, and documents (and all changes, modifications and additions thereto) executed and delivered in connection with the transactions contemplated thereby be and hereby are approved and ratified and that the Authorized Official be and hereby is authorized to execute and deliver such documents.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough of Tarentum assures, where applicable, the provision of the full local share of the project costs.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough of Tarentum assures, that the project will be awarded or under construction within 180 days after contractual execution.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA ADOPTING THE TARENTUM BOROUGH ACT 537 FACILITY PLAN FOR SUBMISSION TO THE DEPARTMENT OF ENVIRONMENTAL PROTECTION.
WHEREAS, Section 5 of the Act of January 24, 1966, P.L. 1535, No. 537, known as the “Pennsylvania Sewage Facilities Act”, as Amended, and the Rules and Regulations of the Pennsylvania Department of Environmental Protection (Department) adopted thereunder, Chapter 71 of Title 25 of the Pennsylvania Code, requires the municipality to adopt an Official Sewage Facilities Plan providing for sewage services adequate to prevent contamination of waters and/or environmental health hazards with sewage wastes, and to revise said plan whenever it is necessary to meet the sewage disposal needs of the municipality; and
WHEREAS, Gibson-Thomas Engineering Co., Inc., has prepared an Act 537 Plan which provides planning for the implementation of the selected alternative in the October 2017 Long Term Control Plan Addendum (LTCP) which was approved by the U.S. Environmental Protection Agency (USEPA) on March 22, 2018 and as directed by PA DEP Administrative Order of March 29, 2018 must be implemented. A regional solution was chosen based on SSO Guidelines and CSO Policy’s cost effective analysis procedure, including post-construction monitoring requirements after implementation. The selected regional solution is Alternative I which is comprised of the following six (6) options:
- Option 1: Directly Connected Stream Removal at CSOs 017 & 019
- Option 2: Increase Upper Little Bull Creek Pipe Diameter
- Option 3: Increase Bull Creek Pump Station Pumping Capacity (19.5 MGD) & Force Main Addition from Pump Station to MH N020
- Option 4: 75 MG Equalization Tank at WWTP & Force Main Extension from MH N020 to WWTP
- Option 5: Consolidate CSOs Upstream of CSO 014
- Option 6: CSO Modifications-Increase Weir Elevations & Improve CSO Chamber Access
Upon submission of the required Part II Water Quality Management Permit, the plan will be implemented as per the following proposed implementation schedule:

WHEREAS, Tarentum Borough finds that the Facility Plan described above conforms to applicable zoning, subdivision, other municipal ordinances and plans, and to a comprehensive program of pollution control and water quality management.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, hereby adopt and submit to the Department of Environmental Protection for its approval of the “Official Plan” of the municipality in the above referenced Facilities Plan. The municipality hereby assures the Department of the complete and timely implementation of the said plan as required by law. (Section 5, Pennsylvania Sewage Facilities Act as amended).

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA WHICH ACKNOWLEDGES THAT NO EMPLOYEE CONTRIBUTION IS REQUIRED BY MEMBERS OF THE BOROUGH OF TARENTUM POLICE DEPARTMENT IN TO THE POLICE PENSION PLAN FOR 2021.
WHEREAS, Borough Council has reviewed the status of the Police Pension Plan; and
WHEREAS, Borough Council has reviewed the bargaining agreement between the Borough of Tarentum and the Tarentum Borough Police Wage and Policy Committee, with specific emphasis on Article 18, Section 18.4.
NOW, THEREFORE, BE IT RESOLVED, the Council of the Borough of Tarentum hereby determines that no employee contributions to the Police Pension Plan will be necessary for the calendar year 2021.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA APPROVING THE ACQUISITION AND SUBSEQUENT DISPOSITION OF NUMEROUS PARCELS OF VACANT PROPERTY KNOWN AS BLOCK AND LOT NUMBER 1223-K-186 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF TARENTUM BOROUGH.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, in cooperation with the County of Allegheny and the Redevelopment Authority of Allegheny County are participating in the Allegheny County Vacant Property Program (Program); and
WHEREAS, certain properties have been submitted to the County for consideration under the Program known and identified as Block and Lot Number 1224-J-251; and
WHEREAS, under the Program the Municipality is required to review the property acquisition and propose disposition, and submit its approval to the County that said acquisition and proposal resale is in accordance with the Municipality’s comprehensive plan.
NOW, THEREFORE, BE IT RESOLVED by the Tarentum Borough Council as follows:
- That the above listed property has been reviewed by the Borough of Tarentum and the Borough approves that the acquisition and subsequent disposition under the Program would be in accordance with the comprehensive plan of Tarentum Borough.
- That a certified copy of this Resolution should be forwarded to the County of Allegheny and the Redevelopment Authority.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA DESIGNATING THE RATES FOR METERED WATER SOLD BY THE BOROUGH TO ITS CUSTOMERS, INCLUDING THE TOWNSHIP OF EAST DEER AND REPEALING ALL RATES INCONSISTENT HEREWITH.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, is authorized under the Borough Code Section 3301.1 to adopt ordinances and resolutions for any purpose and as deemed beneficial to the borough, 8 Pa C.S. § 3301.1; and
WHEREAS, operational costs including labor, electricity, and raw chemicals and the continued updating and maintenance of the water treatment plant and its ancillary facilities to manufacture potable water have increased on a regular basis; and
WHEREAS, the Council of the Borough of Tarentum desires to designate and amend rates to sufficiently compensate for the current costs of water production; and
WHEREAS, the Council of the Borough of Tarentum desires to designate and amend rates for metered water sold to Tarentum Borough customers and to the Township of East Deer; and
WHEREAS, the Council of the Borough of Tarentum has previously ordained and enacted legislation that allows for water rate modifications to be approved by Resolution of Council.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, as follows:

WHEREAS, Tarentum Borough acknowledges it is a participant in said project.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA ADOPTING THE MULTI-MUNICIPAL COMPREHENSIVE PLAN FOR THE BOROUGH OF TARENTUM.
WHEREAS, the Pennsylvania Municipalities Planning Code (MPC), 53 P.S. §1010 et seq., requires municipal comprehensive plans to be reviewed at least every 10 years; and
WHEREAS, agencies of the Commonwealth are required to rely upon municipal comprehensive plans when approving grants and permits for infrastructure and facilities, and to give priority consideration to applications for financial or technical assistance for projects that are consistent with the comprehensive plan; and
WHEREAS, the Borough of Tarentum entered into a joint contract with Harrison Township and Brackenridge Borough through Allegheny County Economic Development (ACED) for the municipal planning grant program to assist with the development of a Multi-Municipal Comprehensive Plan; and
WHEREAS, the joint municipalities have utilized ACED funding to engage the services of Pashek + MTR to assist with development of a Multi-Municipal Comprehensive Plan; and
WHEREAS, the consulting team of Pashek + MTR, in conjunction with Harrison Township, Brackenridge Borough and Tarentum Borough, has prepared the Multi-Municipal Comprehensive Plan attached hereto and incorporated herein by reference as Exhibit “A”, which complies with the requirements set forth in Sections 210 – 212 of the Pennsylvania Municipalities Planning Code.
WHEREAS, prior to all required public meetings and hearings held by the governing body, the municipality submitted the proposed Multi-Municipal Comprehensive Plan to the county planning agency for recommendations and forwarded copies to all contiguous municipalities and to the local school district for their review and comment; and
WHEREAS, Tarentum Borough and the Tarentum Borough Planning Commission did comply with the requirements set forth in Sections 301.3 and 302 of the Pennsylvania Municipalities Planning Code with respect to public meetings, public notice, public comment and public hearings, and all deadlines set forth therein, and;
WHEREAS, the Tarentum Borough Planning Commission is empowered to recommend to the Borough Council the adoption of a Multi-Municipal Comprehensive Plan for the physical development of the Borough, pursuant to Section 209.1 of the Pennsylvania Municipalities Planning Code; and
WHEREAS, the Planning Commission, at their November 17, 2020 agenda meeting, unanimously approved the Comprehensive Plan be recommended to Borough Council for approval at the December 1, 2020 public meeting of Borough Council; and
WHEREAS, notice of public hearing on the proposed Multi-Municipal Comprehensive Plan was published in the Valley News Dispatch on October 7, 2020; and
WHEREAS, the Borough of Tarentum, pursuant to Section 302(b) of the Pennsylvania Municipalities Planning Code, provided public notice and subsequent public hearing on December 1, 2020 at 5:30 p.m. relative to the proposed Multi-Municipal Comprehensive Plan; and
WHEREAS, Borough Council held the required public hearing on December 1, 2020, after complying with the notice and 45-day public review and comment requirements; and
WHEREAS, the Borough Council of the Borough of Tarentum is of opinion that the Multi-Municipal Comprehensive Plan should be adopted as the Borough’s primary planning document.
NOW, THEREFORE, BE IT RESOLVED, that the Borough of Tarentum of Allegheny County hereby adopts the proposed Multi-Municipal Comprehensive Plan, attached hereto and marked as Exhibit “A”, pursuant to Article III and Article XI of the Pennsylvania Municipalities Planning Code.

WHEREAS, said proposed budget was duly advertised by Public Notice as required by Section 1308 of the Borough Code; and
WHEREAS, the Council of the Borough of Tarentum desires to adopt said proposed budget as the final budget for the fiscal year 2021 as required by Section 1310 of the Borough Code.

WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania from time to time has vacancies in the office of Councilperson and it is the duty of Borough Council to fill such vacancies, the following appointments to fill vacancies is hereby recognized and resolved; and
WHEREAS, a vacancy occurred at the time of the January 10, 2019 public meeting and the vacancy was subsequently filled by a vote of Council on February 7, 2019; and
WHEREAS, it is resolved that Brian Snyder was appointed by a majority vote of Council to fill the remainder of the unexpired term as Councilperson for the Third Ward, said term to expire on the first Monday in January after the next municipal election.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA APPROVING THE PUBLICATION OF DELINQUENT TARENTUM BOROUGH PROPERTY TAXPAYERS.
WHEREAS, pursuant to the Borough Code, 8 Pa.C.S. § 3301.1(c), entitled “Resolutions”, Borough Council is authorized to make and adopt Resolutions of public policy of Borough council, and;
WHEREAS, the Council of Tarentum Borough understands that tax revenue is a primary source of funding for vital public services, from police protection and public works to the general health, safety and welfare of the Borough, and;
WHEREAS, the Council of Tarentum Borough recognizes that persons failing to pay property tax owed by law places a burden on remaining taxpayers to maintain a sufficient level of funding necessary for municipal services, and;
WHEREAS, the current amount of outstanding delinquent property taxes is creating a detrimental impact upon the remaining taxpayers of Tarentum Borough.
NOW, THEREFORE, BE IT RESOLVED, with the foregoing recitals being incorporated herein by reference thereto, the Council of Tarentum Borough, Allegheny County, Pennsylvania, hereby RESOLVES as follows:
- All property taxes which remain unpaid following December 31 of the prior year shall be considered delinquent property taxes.
- In February of each year, the Borough property tax collector shall report to Borough Council the delinquent taxes on real property from the prior year.
- The Borough tax collector shall provide annual notice to all taxpayers that delinquent property taxes may be published in a newspaper of general circulation and shall be made publicly available via the Tarentum Borough web site.
- The real property owner reflected on the tax records as of the January 1 delinquent date shall be listed in said public notice.
- The tax amount shown on the publication may not include interest, fees, costs and prior tax year past due amounts, the omission of which does not constitute a waiver of the taxing body’s claim for these items.
- The tax amount shown shall be subject to accrued interest until paid.
- Upon satisfaction of delinquent property tax payment amounts or upon enrollment and compliance with a payment plan, the tax payer name will be removed from publication.
- All other current delinquent property tax collection efforts shall remain in full force and effect.

WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, desires to obtain funds from the RAAC in the amount of $250,000;
NOW, THEREFORE, BE IT RESOLVED, that the Borough of Tarentum of Allegheny County hereby formally requests a grant from the RAAC for the Borough of Tarentum East 9th Avenue project.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough of Tarentum does hereby designate Thomas J. Benecki (the “Authorized Official”) as the official to file all applications, documents and forms between the Borough of Tarentum and the RAAC.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Applicant is hereby authorized to enter into the Grant Contract between the applicant and RAAC (the “Grant Contract”) and any and all documents relating to the Grant Contract as may be required or necessary (said Grant Contract and other documents are collectively referred to as the “Grant Documents”).
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the execution and delivery of the Grant Documents as well as all other agreements, writings, and documents (and all changes, modifications and additions thereto) executed and delivered in connection with the transactions contemplated thereby be and hereby are approved and ratified and that the Authorized Official be and hereby is authorized to execute and deliver such documents.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough of Tarentum assures, where applicable, the provision of the full local share of the project costs.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA INDICATING THE INTENT TARENTUM BOROUGH TO WORK ALONG WITH ALLEGHENY COUNTY TO ACCOMPLISH THE GOALS OF THE LIVE WELL ALLEGHENY CAMPAIGN
WHEREAS, in January of 2014, Allegheny County Executive Rich Fitzgerald, under the leadership of the Board of Health and Health Department Director Dr. Karen Hacker, launched a comprehensive, innovative strategy on wellness called Live Well Allegheny; and
WHEREAS, living well is a broad concept that incorporates physical health, mental wellness, personal and community safety, prevention and preparedness, physical activity, nutrition, fitness, managing chronic disease, improving well-being, quality of life, education, improving our standard of living, cessation programs, vaccinations, weight loss, anti-aging, health literacy and so much more; and
WHEREAS, the health of our county residents, and the health of [Insert municipality name] residents, requires a coordinated effort to ensure that programs, studies, outreach events and other efforts have the ability to improve our overall health; behavior changes requires a cultural change which Live Well Allegheny is intent on providing; and
WHEREAS, one of the main initiatives of the Live Well Allegheny campaign is to endeavor to have the participation of all 130 municipalities and to provide programming in each of those communities; the campaign can enhance the capacity of communities to effectively plan, implement, evaluate and sustain activities and interventions that accomplish the goals;
NOW, THEREFORE, BE IT RESOLVED that the Borough of Tarentum will endeavor to work along with Allegheny County to accomplish the goals of the Live Well Allegheny campaign; and
FURTHERMORE, that the Council of the Borough of Tarentum pledges to take the following steps within our community toward these goals:
- Develop indoor and outdoor wellness trails accessible to residents of all abilities
- Encourage multi-modal transportation of residents by providing facilities or policies that encourage walking and bike riding
- Promote and support farmers’ markets
- Encourage involvement with community volunteer activities
- Promote smoke-free buildings and perimeters
- Provide health information focused on monthly or seasonal events
- Utilize web sites and social media to provide information on physical activity, nutrition, stress management, tobacco cessation, and other health and wellness related initiatives

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA APPROVING THE AMENDMENT OF THE ARTICLES OF INCORPORATION OF THE UPPER ALLEGHENY JOINT SANITARY AUTHORITY INCREASING THE TERM OF EXISTENCE FOR FIFTY YEARS FROM THE DATE OF APPROVAL AND FILING OF THE ARTICLES OF AMENDMENT OF THE ARTICLES OF INCORPORATION AND DIRECTING THAT THE AMENDMENT TO THE ARTICLES OF INCORPORATION BE EXECUTED AND SUBMITTED TO THE SECRETARY OF THE COMMONWEALTH AFTER PROPER ADVERTISEMENT.
WHEREAS, the Articles of Incorporation of the Upper Allegheny Joint Sanitary (“Authority”) were initially adopted by the Borough Council of the Borough of Tarentum, on March 7, 1960 pursuant to the provisions of the Municipality Authorities Act of 1945, P.L. 382, as amended (53 Pa. C.S. §5601 et seq.), (the “Act”); and
WHEREAS, all of the public purposes which were present at the time of the initial approval of the creation of the Authority pursuant to an Ordinance adopted by the Borough Council of the Borough of the Borough of Tarentum continue to exist; and
WHEREAS, the Borough Council desires to extend the term of existence of the Authority for fifty years from the effective date determined by the Pennsylvania Department of State;
NOW, THEREFORE, BE IT RESOLVED AND ENACTED, by the Borough Council of the Borough of Tarentum, Allegheny County, Pennsylvania, and the Borough of Tarentum hereby RESOLVES AND ENACTS by the authority of the same as follows:
- It is the desire of the Borough Council that the Articles of Incorporation of the Authority be amended to extend the term of existence of the Authority for fifty years from the date of approval of the Articles of Amendment of the Articles of Incorporation of the Authority by the Pennsylvania Department of State pursuant to the Act.
- That in pursuit of this desire and intention, and in conformity with the terms and provisions of the Act, the proposed Articles of Amendment of the Articles of Incorporation of the Authority are hereby set forth in full and attached in Exhibit A.
- The proposed Articles of Amendment of the Articles of Incorporation shall be executed by two duly authorized officers of the Authority and the Seal of the Authority shall be affixed thereto. The Authority solicitor is authorized and directed to cause to be published the Notice of Intention to File Articles of Amendment with the Secretary of the Commonwealth as required by the Act, and when the Articles of Amendment are properly executed, they shall be filed with the Secretary of the Commonwealth.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA APPROVING THE ACQUISITION AND SUBSEQUENT DISPOSITION OF NUMEROUS PARCELS OF VACANT PROPERTY KNOWN AS BLOCK AND LOT NUMBER 1223-K-186 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF TARENTUM BOROUGH.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, in cooperation with the County of Allegheny and the Redevelopment Authority of Allegheny County are participating in the Allegheny County Vacant Property Program (Program); and
WHEREAS, certain properties have been submitted to the County for consideration under the Program known and identified as Block and Lot Number 1223-K-186; and
WHEREAS, under the Program the Municipality is required to review the property acquisition and propose disposition, and submit its approval to the County that said acquisition and proposal resale is in accordance with the Municipality’s comprehensive plan.
NOW, THEREFORE, BE IT RESOLVED by the Tarentum Borough Council as follows:
- That the above listed property has been reviewed by the Borough of Tarentum and the Borough approves that the acquisition and subsequent disposition under the Program would be in accordance with the comprehensive plan of Tarentum Borough.
- That a certified copy of this Resolution should be forwarded to the County of Allegheny and the Redevelopment Authority.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA AUTHORIZING THE ESTABLISHMENT OF A PROCEDURE GOVERNING THE SALE OF PERSONAL PROPERTY VALUED AT LESS THAN ONE THOUSAND DOLLARS ($1,000).
WHEREAS, section 1201.2 (a) of the Borough Code authorizes the Council of Tarentum Borough to establish a procedure for the sale of the surplus personal property which has an estimated value of less than $1,000; and
WHEREAS, the Council of Tarentum Borough now desires to establish such a procedure.
NOW, THEREFORE, BE IT RESOLVED, that the Council of the Borough of Tarentum hereby authorizes the borough manager to sell the personal property of the Borough which has an estimated value of less than One Thousand Dollars ($1,000) pursuant to the following procedure.
- The borough manager may determine the value of the subject personal property (the “property”) by obtaining from a vendor dealing in the Property, or goods substantially similar to the Property, in their regular course of business.
- The lowest estimate shall constitute the minimum permissible sale price for the Property (the “Minimum Price”).
- The borough manager may then solicit and accept written offers of purchase at a price in excess of the Minimum Price (individually referred to as a “Purchase Offer”).
- After three (3) consecutive business days following receipt of the most recent Purchase Offer, the borough manager may accept the highest Purchase Offer received to that date and sell the property with or without approval of council. In the alternative, the Borough Manager may reject “any Purchase Offers or other offers at any time.
- The borough manager shall report such sale at the Council Meeting immediately subsequent to such sale.

WHEREAS, the Borough of Tarentum owns or controls poles, ducts, conduits, rights-of-way and other facilities located with the Borough of Tarentum, Pennsylvania to which wires, cable and other facilities may be attached to provide internet, cable television and/or telecommunications services; and
WHEREAS, the use of these structures by third parties may be regulated by various state and federal laws, including but not limited to the Communication Act of 1934 (47 U.S.C. Section 151, et seq.), as amended, and specifically the provisions of 47 U.S.C. Section 224 (the “Act”), and as interpreted in the duly authorized rules and regulations of the Federal Communications Commission; and
WHEREAS, the Borough of Tarentum does regulate the use of these structures by implementing a pole attachment fee; and
WHEREAS, the Borough of Tarentum has determined that is necessary to increase the current rate from $14.80 per pole to $19.80 per pole as of January l, 2020;
NOW, THEREFORE, BE IT RESOLVED, that the Council of the Borough of Tarentum hereby increases the pole attachment fee from $14.80 per pole to $19.80 per pole as of January 1, 2020.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA ACKNOWLEDGING THE APPOINTMENT OF VACANCIES IN THE OFFICE OF BOROUGH COUNCILPERSONS.
WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania from time to time has vacancies in the office of Councilperson and it is the duty of Borough Council to fill such vacancies, the following appointments to fill vacancies is hereby recognized and resolved; and
WHEREAS, a vacancy occurred at the time of the 2018 Borough reorganization and the vacancy was subsequently filled by a vote of Council on January 22, 2018; and
WHEREAS, it is resolved that Scott Dadowski was appointed by a majority vote of Council to fill the remainder of the unexpired term as Councilperson for the Second Ward, said term to expire on the first Monday in January after the next municipal election.

WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, in cooperation with the County of Allegheny and the Redevelopment Authority of Allegheny County are participating in the Allegheny County Vacant Property Program (Program); and
WHEREAS, certain properties have been submitted to the County for consideration under the Program known and identified as Block and Lot Numbers 1223-P-00215 and 1223-P-00216; and
WHEREAS, under the Program the Municipality is required to review the property acquisition and propose disposition, and submit its approval to the County that said acquisition and proposal resale is in accordance with the Municipality’s comprehensive plan.
NOW, THEREFORE, BE IT RESOLVED by the Tarentum Borough Council as follows:
- That the above listed properties have been reviewed by the Borough of Tarentum and the Borough approves that the acquisition and subsequent disposition under the Program would be in accordance with the comprehensive plan of the Borough of Tarentum.

WHEREAS, the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania from time to time must alter fees and rates for street openings, surface openings and pavement openings in the Borough of Tarentum pursuant to Chapter 216, Article IV of the Borough Code; and
WHEREAS, the Council of the Borough of Tarentum wishes to set flat fees for street opening applications pursuant to Chapter 216, Article IV, Section 216-24 of the Borough Code; and
WHEREAS, the Council of the Borough of Tarentum wishes to set a permit fee of a flat rate plus computation of the square footage of opening pursuant to Chapter 216, Article IV, Section 216-24 of the Borough Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Tarentum that fees for street openings, surface openings and pavement openings are set as follows:

WHEREAS, the citizens of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania rely on local government to experience a high quality of life in our community; and
WHEREAS, local governments work twenty-four hours a day, seven days a week to deliver municipal services such as fire, police and emergency medical services which create safe communities; and
WHEREAS, the methods of funding these vital municipal services are not always clearly understood by citizens; and
WHEREAS, it is one of the responsibilities of municipal officials to ensure that legislators, media and citizens understand their local government through open and frequent communication using various avenues and means; and
WHEREAS, through education and awareness, citizens, community leaders and municipal staff can work together to ensure that services provided by the Borough of Tarentum can remain exceptional elements toward a high quality of life in our community.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Tarentum that Tarentum Borough joins with the Allegheny League of Municipalities in declaring April 9, 2018 to April 13, 2018 as local government week.

WHEREAS, the hiring of police officers in the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania must occur through the Civil Service Testing procedure; and
WHEREAS, the Council of the Borough of Tarentum has the authority pursuant to Chapter 11 of the Pennsylvania Borough Code to set rules and regulations for the hiring of civil service employees; and
WHEREAS, the Council of the Borough of Tarentum desires to set forth minimum experience hours and application fees for testing and hiring full time officers; and
WHEREAS, at a public meeting on January 3, 2017 Borough Council did deliberate and adopt a minimum hour requirement and application fee modification which does not appear to be reduced to writing.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Tarentum that the Borough shall ratify and adopt a set of minimum hours of experience for full time police officers at 6,000 hours of experience and the application fee for civil service testing shall be set at $75.00 per applicant, as approved by vote of Borough Council at a public meeting held on January 3, 2017.

RESOLUTION OF THE BOROUGH OF TARENTUM, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA REQUESTING FUNDS FROM THE 2017 MUNICIPAL PLANNING GRANT PROGRAM FOR A MULTI-MUNICIPAL COMPREHENSIVE PLAN.
WHEREAS, Allegheny County Economic Development (ACED) has established the 2017 Municipal Planning Grant Program, and;
WHEREAS, Harrison Township, Brackenridge Borough, and Tarentum Borough intend to request funds from the 2017 Municipal Planning Grant Program in the amount of $50,000 for the proposed multi-municipal comprehensive plan, and;
WHEREAS, Tarentum Borough acknowledges it is a participant in said project, and;
WHEREAS, Tarentum Borough has authorized Harrison Township to make application for such grant on our behalf;
NOW THEREFORE, BE IT RESOLVED, that Tarentum Borough hereby allocates $9,787.00 of matching funds to said project,
NOW THEREFORE, BE IT FURTHER RESOLVED, that Tarentum Borough agrees to reimburse the County of Allegheny for a proportional share, which shall be equal to the full grant amount received from the County divided by the number of participating municipalities, if the multi-municipal comprehensive plan is not adopted by the Municipality in accordance with the applicable requirements of the PA Municipalities Planning Code within 6 months of the completion of the final draft.

WHEREAS, the Keystone Opportunity Zone, Keystone Opportunity Expansion Zone and Keystone Opportunity Improvement Zone Act (Act of October 6, 1998, P.L. 705, No. 92), as amended, hereinafter referred to as the “Act,” authorizes political subdivisions to apply to the Pennsylvania Department of Community and Economic Development (DCED) for designation of an area within the respective political subdivision as a KOEZ granting exemptions, deductions, abatements or credits from all local taxes identified in the Act; and
WHEREAS, approval of benefits provided in the Act will result in improving the economic, physical, and social conditions within the Proposed KOEZ by stimulating existing businesses employment, creating new employment and diminishing blight; and
WHEREAS, it is expected that increased private and public-sector investors will reverse the disinvestment and conditions of blight within the Proposed KOEZ by the time of its termination; and
WHEREAS, the Proposed KOEZ is not less than ten acres but not more than 375 acres in the aggregate; and
WHEREAS, the Proposed KOEZ is comprised of parcels which are deteriorated, underutilized or unoccupied.
NOW, THEREFORE, BE IT RESOLVED by the Borough of Tarentum, Allegheny County that effective as of this date, October 4, 2018, contingent only upon DCED’s approval of the application for the proposed new KOEZ, the following provisions shall apply:
- Real Property Tax on the Proposed KOEZ is 100% exempt in accordance with the provisions and limitations hereinafter set forth in accordance with the Act, such exemption to begin on January 1, 2019 and to terminate December 31, 2028 (a ten year period).
- The following shall be exempt, relative to the subject parcels/tract, for the term, and any extension thereof, of the KOEZ:
- Business gross receipts tax for operations conducted by a Qualified Business within the expansion zone.
- Business privilege tax and Business Occupancy Tax.
- Tax on the earned income received by a resident of the expansion zone.
- Tax on the net profits of a Qualified Business attributable to business activity conducted within the expansion zone
- Mercantile tax attributable to business activity by a Qualified Business conducted within the expansion zone.
- Sales and Use tax for purchases exclusively used and consumed by the qualified business in the expansion zone
Benefits to begin on January 1, 2019 and to end on December 31, 2028 (ten year period).
- The provisions of the Act not herein enumerated, shall, nevertheless, be incorporated as part of this Ordinance by reference.
- This resolution shall be effective upon execution, conditioned upon the approval of the application by DCED.
