WHEREAS, the Council of the Borough of Tarentum, County of Allegheny and Commonwealth of Pennsylvania, has received a duly executed petition to vacate that part of Rose Alley from East Fourth Avenue south to its dead end; and

WHEREAS, the petition is from the only known landowner abutting said portion of Rose Alley; and

WHEREAS, at least fifteen (15) days’ notice of a hearing on this petition had been advertised in the local newspaper; and

WHEREAS, a public hearing had been advertised in the local newspaper; and

WHEREAS, a public hearing has been conducted on the petitioner’s request on the 18th of January, 2010; and

WHEREAS, 53 P.S. §46742 authorizes Council to vacate streets and alleys upon petition and hearing; and

WHEREAS, the above-mentioned petition releases the Borough from any damages resulting or which could result from the vacating of Rose Alley from East Fourth Avenue south to its dead end; and

WHEREAS, the Borough will no longer have to maintain Rose Alley; and

WHEREAS, the public interest will be best served by vacating the above referenced section of Rose Alley.

WHEREFORE, BE IT ORDAINED AND ENACTED, by Council of the Borough of Tarentum and it is hereby Ordained and Enacted by authority of the same to vacate that portion of Rose Alley south from East Fourth Avenue to its dead end.

THIS ORDINANCE SHALL BECOME EFFECTIVE FORTY (40) DAYS AFTER ITS ENACTMENT.

WHEREAS; the Commonwealth of Pennsylvania has enacted Act 51 of 2009 providing a benefit for the surviving spouse and eligible beneficiaries of a Pennsylvania law enforcement officer killed in the line of duty; and

WHEREAS; this benefit is applicable to the police officers of this Borough of Tarentum, and municipal police pension plans to provide a Killed-in-Service benefit equivalent to the deceased officer’s monthly salary to a surviving spouse and beneficiaries; and

WHEREAS; the benefit currently provided in the Borough of Tarentum Police Pension Plan as a Killed in Service benefit in the amount of 100% of salary is now duplicative of the benefit provided in accordance with Act 51 of 2009.

NOW, WHEREFORE BE IT ORDAINED AND ENACTED by the Council of the Borough of Tarentum, County of Allegheny, Commonwealth of Pennsylvania, and it is hereby Ordained and Enacted by and with the authority of the same, as follows:

  1. Effective immediately, the following section of the Police Pension Plan,

Section 7.04, Killed in Service – Pensions for the families of members killed in service shall be calculated at one hundred per centum of the member’s salary at the time of death

BE AND THE SAME IS HEREBY REPEALED and said provision shall no longer be a part of the Police Pension Plan; and FURTHER, Act 51 of 2009 is hereby adopted.

An ordinance of the Borough of Tarentum, Allegheny County, Commonwealth of Pennsylvania, adopting the 2009 edition of the International Property Maintenance Code, regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and providing for the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures in the Borough of Tarentum and by providing for the issuance of permits and collection of fees and fines for violation therefore and repealing Ordinance No. 04-09 of the Borough of Tarentum and all other Ordinances and parts of the Ordinances in conflict herewith.

WHEREAS, Council of the Borough of Tarentum wishes to adopt the International Property Maintenance Code of the year 2009 for the health, safety and welfare of the Borough of Tarentum.

Section 1. That a certain document, three (3) copies of which are on file in the Office of the Borough of Tarentum, being marked and designated as the International Property Maintenance Code, 2009 edition as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Tarentum in the Commonwealth of Pennsylvania for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and providing for the condemnation of building and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the Office of the Borough of Tarentum are hereby referred to, adopted and made a part hereof, as if fully set out in this ordinance, with the additions, insertions deletions and changes, if any, prescribed in Section 2 of this Ordinance.

Section 2. The following sections are hereby revised and added:

Any person violating this Ordinance shall be subject to a fine of no more than $600.00 and no less than $100.00 and imprisonment of no more than thirty (30) days and court costs.

Each day of violation shall be subject to fines and penalties, consecutively; for each day shall constitute a separate offense.

Section 3. That Ordinance No. 04-09 of the Borough of Tarentum as amended which adopts the former BOCA Basic Property Maintenance Code as amended, and all other ordinances or part of ordinances in conflict herewith are hereby repealed.

Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Borough of Tarentum hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.

Section 5. That nothing in this ordinance or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.

Section 6. That the Manager of the Borough of Tarentum is hereby ordered and directed to cause this ordinance to be accessible as well as the International Property Maintenance Code to the public during all normal business hours on request.

Section 7. That this ordinance and the rules, regulations, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect immediately upon adoption by Council.

WHEREAS, Council of the Borough of Tarentum recognizes that Riverview Memorial Park is a special asset to the citizens of the Borough and surrounding communities which provides peaceful beauty, relaxing walks and is the venue for countless community events; and

WHEREAS, Council of the Borough of Tarentum wishes to provide everyone who enjoys the Riverview Memorial Park the best experience possible; and

WHEREAS, Council of the Borough of Tarentum has identified certain activities which interferes with enjoyment and possess a threat to the general health, safety and welfare of citizens using the park,

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by Council of the Borough of Tarentum, and it is hereby ordained and enacted by authority of same as follows:

SECTION I. The following activities and behavior are strictly prohibited in the Riverview Memorial Park:

1.01. Use of skateboards and bicycles.

1.02. Consumption of alcoholic beverages.

1.03. The walking of any dog or cat, or any other domesticated animal, leashed or not.

1.04. Use of any illegal drugs.

1.05. Any acts of vandalism or criminal mischief.

SECTION II. Violations and Penalties.

Any person convicted of any activity in I supra shall be subject to the following fines:

2.01. 1st Offense – $10.00 and court costs.

2.02. 2nd Offense: $50.00 and court costs.

2.03. 3rd Offense and subsequent convictions: $600.00 and court costs.

2.04. Any person refusing or neglecting to pay fines and costs is subject to up to 30 days confinement in the Allegheny County Jail.

SECTION III. The Borough shall post notices at main entrances to the Riverview Memorial Park of the acts of behavior prohibited and that fines are up to $600 for violations.

SECTION IV. This Ordinance shall be read and enforced pari materia with Chapter 177 of the Borough Code.

WHEREAS, The Council of the Borough of Tarentum has determined that indoor furniture and appliances placed or stored on the exterior of property raises serious health concerns because the materials contained in the fabric and filling of upholstered pieces and the cabinetry of household appliances harbor nesting places for rodents and insects, creating a nuisance and health hazard to the immediate neighbors and community at large; and

WHEREAS, the Council of the Borough of Tarentum has determined that indoor furniture can be flammable, and a fire hazard to property and a burden on services of the Borough’s volunteer fire companies; and

WHEREAS, Council of the Borough of Tarentum has determined that appliances present a physical danger to young children; and

WHEREAS, Council of the Borough of Tarentum has determined that tires improperly placed or stored on the exterior of property raise serious health concerns because collections of stagnant water harbor nesting places for rodents and insects, creating a nuisance and health hazard to the immediate neighbors and community at large; and

WHEREAS, the Council of the Borough of Tarentum has determined that tires can be flammable and inappropriate storage poses a noxious gas danger and fire hazard to property and a burden on services of the Borough’s volunteer fire companies; and

WHEREAS, Council of the Borough of Tarentum has determined that motor vehicle parts, engine parts, machine parts, batteries, etc. placed or stored on the exterior of property raise serious health concerns, pose substantial risk of environmental spills or leakage and harbor nesting places for rodents and insects, creating a nuisance and health hazard to the immediate neighbors and community at large; and

WHEREAS, Council of the Borough of Tarentum has determined that marked or unmarked chemical containers, vats or drums placed or stored on the exterior of property pose substantial risk of environmental spills or leakage, cause serious health concerns, present danger to pets and animal, and harbor nesting places for rodents and insects, creating a nuisance and health hazard to the immediate neighbors and community at large; and

WHEREAS, Council of the Borough of Tarentum has determined that that marked or unmarked chemical containers, vats or drums present a danger to young children;

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by Council of the Borough of Tarentum, and it is hereby ordained and enacted by authority of same as follows:

Section I. Definitions.

“Upholstered furniture” means any furniture that contains attached filling material and is used or intended to be used for sitting, reclining, sleeping or resting indoors.

“Appliances” means any range, stove, refrigerator, freezer, microwave, washer or dryer.

“Landlord” means a duly registered property owner letting real property for use or hire.

“Tenant” means lessee, occupant, resident.

Section II.

  1. The use, placement, or storage of any upholstered furniture manufactured primarily for indoor use, including but not limited to mattresses and box springs, sofas, loungers, recliners and chairs and the use, placement, or storage of any appliance shall be prohibited outdoors, including any front, back or side yard, porch, stoop, landing, patio, deck or balcony.
  2. The use, placement or storage of any motor vehicle part, engine parts, tires, batteries, chemical containers or hazardous material shall be prohibited outdoors, including any front, back or side yard, porch, stoop, landing, patio, deck or balcony.

SECTION III.

Any person violating this Ordinance or Landlord permitting violation of this Ordinance shall be fined a minimum of Two Hundred and 00/100 ($200.00) dollars and a maximum of up to Five Hundred and 00/100 ($500.00) dollars plus Court Costs. Each day after the FIVE (5) day WARNING NOTICE is issued that the condition continues shall constitute a separate offense.

SECTION IV. The Tarentum Code Enforcement Officer or the Tarentum Police may enforce this Ordinance on or after the date following the date FIVE (5) day WARNING NOTICE posted on the door of the premises indicating violation of this Ordinance.

SECTION V. Landlords are deemed to violate this Ordinance if they have received a Five (5) day Warning Notice or if they are not Registered Owners.

SECTION VI. All prior Ordinances or sections thereof conflicting with this Ordinance are hereby repealed.
